Federal Controlled Substance Status

Psilocybin is classified as a Schedule I controlled substance under the United States Controlled Substances Act (21 U.S.C. 812). Schedule I substances are defined by the federal government as having "no currently accepted medical use and a high potential for abuse." This federal classification remains in effect regardless of state law.

Cedars and Spores acknowledges this federal classification and ensures that all clients are fully informed of the legal status of psilocybin at both the state and federal levels prior to participation in any retreat.

Colorado Natural Medicine Health Act

In November 2022, Colorado voters passed Proposition 122, the Natural Medicine Health Act, which decriminalized the personal use, possession, and cultivation of certain natural medicines -- including psilocybin and psilocin -- for adults aged 21 and older. The Act also directed the Colorado Department of Regulatory Agencies (DORA) to establish a regulated framework for licensed Healing Centers and trained Facilitators.

Cedars and Spores operates in alignment with the provisions of the Natural Medicine Health Act and monitors the evolving regulatory framework as the Natural Medicine Division establishes licensing and operational requirements.

Clients should be aware that Colorado state law and federal law are not in agreement regarding the legal status of psilocybin. While Colorado has established a framework for legal access, federal law continues to prohibit the manufacture, distribution, and possession of psilocybin.

Not FDA-Approved Therapy

Psilocybin-assisted therapy is not approved by the U.S. Food and Drug Administration (FDA) for the treatment of any condition. While psilocybin has received Breakthrough Therapy designation from the FDA for treatment-resistant depression -- a designation that expedites the development and review process -- this designation does not constitute approval.

The services offered by Cedars and Spores do not constitute FDA-approved medical treatment. Participation in a Cedars and Spores retreat is not a substitute for conventional medical care.

No Guaranteed Outcomes

Cedars and Spores does not promise, guarantee, or imply any specific therapeutic outcome from participation in a retreat. Individual responses to psilocybin-assisted therapy vary widely. While published research has demonstrated statistically significant benefits in clinical trial populations, these findings do not predict the outcome for any individual.

Potential risks of psilocybin include, but are not limited to: transient anxiety, psychological distress, nausea, headache, elevated blood pressure and heart rate, and the possibility of a challenging or distressing psychological experience. In rare cases, psilocybin may precipitate prolonged psychological distress. These risks are discussed in detail during the informed consent process.
